ARTICLE 1: SCOPE OF APPLICATION
These general conditions of sale apply to all sales concluded through the website https://www.paint-by-numbers.us/

ARTICLE 2: ORDERS
The automatic recording systems are considered as valid proof of the nature and content of the order. Paint By Numbers® confirms the acceptance of its order to the customer at the e-mail address that this one will have communicated. The sale will be concluded as from the validation by Diamond Embroidery® of the payment of the order i.e. of the date of validation of the payment for the orders regulated on line by bank card or the date of reception of the payment by cheque. Diamond Embroidery® reserves in any case the right to refuse or cancel any order of a customer with whom would exist a dispute relating to the payment of a previous order. 

ARTICLE 3: AVAILABILITY OF ITEMS
As long as our offers and their prices are visible on the site, they are valid. The availability indicated at the time of the consultation of the site by the customer remains dependent on the state of the stock at Paint By Numbers® and of course at the suppliers. 
To carry out our shop window and our sales catalog, we work with databases, enriched according to information communicated by our suppliers. This database includes more than a hundred items, not all of them are stored in our reserves and our offer is then conditioned to the availability of the items at the suppliers. 

Only the definitive break of an item at our suppliers leads to the removal of this one from our sales offer. In the other cases, a new order under a certain period remains possible. 
When there is an unavailability on an ordered product, the customer is informed by e-mail or on the invoice of the shipped products in the case of an order of several items.  

Order delivery deadline: when placing the order and on the order acknowledgement, a delivery deadline is communicated to customers. It is calculated by adding, the time of availability of the longest product, to the time of delivery of the mode of transport selected by the customer.
From the placing of the order, to the shipment of the latter, the customer to the possibility of cancelling his order. 
Particularities:

Pre-order articles : articles to be published are offered on the site https://www.paint-by-numbers.us/ as a Pre-Order. This reservation is made with the indication of a release date announced by the publisher at the time of opening the reservation phase. This release date may be changed at any time by the publisher who is solely responsible for the marketing of its product.

In all cases, Paint By Numbers® will endeavor, as soon as the final release date is reached, to ship the items to customers who have reserved, up to the stock provided by the publisher for the release day. 
 

ARTICLE 4: PRICE 
The prices indicated in euros are deemed net, excluding shipping costs. This price includes the price of the products, the handling, packaging and storage costs of the products. They can be modified at any time without notice, knowing that the articles will be invoiced on the basis in force at the recording of the order. All the orders are invoiced in euros and payable in euros. Any customs fees or local taxes remain the responsibility of the recipient. 
  

ARTICLE 5: SHIPPING COSTS
Postage charges include a contribution to preparation, packaging and postage. Please remember to group all your items on one order. We will not be able to group two separate orders and you will be charged shipping fees for each.
 

ARTICLE 6: PAYMENT
You have several means of payment that offer maximum security guarantees. You can pay: 
  
- By bank or private card (Visa, Eurocard/Mastercard) either directly on the site, in the payment form proposed during the ordering process (secure entry by SSL encryption), by informing the type of card, the number of your card without any space between the digits, the control number (located on the back of your card) as well as the date of validity.   
  
- By Paypal Payment 
  
You have different payment methods and you can even benefit from credit card payment facilities.  

Payment is made at your choice on the secure bank servers of our partners. This implies that no banking information concerning you transits via the site https://www.paint-by-numbers.us/
  
Payment by bank card is therefore perfectly secure; your order will thus be recorded and validated as soon as the payment is accepted by the bank. 

ARTICLE 7: DELIVERY
We deliver to your home or to a relay point. The delivery time includes the time of preparation of the package to which is added the time of routing. Paint By Numbers® delivers worldwide. The buyer is notified by emails of the different stages of the follow-up of his order: the one of preparation and the one of delivery.

The delivery time includes the preparation time and the delivery ensured by our carrier. The announced delivery time of 10 to 20 days is valid from the reception by the buyer of the email of the delivery of the order. The delivery time of (announced by the carrier) does not commit Paint By Numbers® on a longer time.

ARTICLE 8: GUARANTEE - RETURNS - REFUNDS- RETRACTION

The items provided by https://www.paint-by-numbers.us/ are new and guaranteed against any defect. They are identical to those of the traditional trade and come from all the publishers and suppliers referenced. 
  
If it happens that an article is defective or not in conformity, the buyer has 15 working days, as from the reception of the articles, to ask for an exchange or a refund. If the fifteen (15) day period normally expires on a Saturday, Sunday or a holiday or non-working day, it is extended to the next working day.
  
The customer must return the new or unconsumed items in their entirety and in their original packaging, intact, accompanied by all possible accessories, instructions for use and documentation (in its original cellophane packaging imperatively and with the corresponding invoice). In such a situation, the buyer must send the proof of the defect(s) to contact@paint-by-numbers.us (description and photos attached). 
  
In case of exercise of the right of withdrawal, Paint By Numbers® is required to reimburse the sums paid by the customer, without charge, except for the cost of return. The refund is due within a maximum of 14 working days from the date of receipt of the returned package(s). 
  
The return shipping costs then remain at your charge.

In the event of a refund, we guarantee that it is made within 14 days or less from the date of receipt of the returned package. No COD shipments will be accepted for any reason.  

ARTICLE 9: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS
The transfer of ownership of the products to the benefit of the purchaser, will be realized only after full payment of the price by the latter, and this regardless of the date of delivery of the said products. On the other hand, the transfer of the risks of loss and deterioration of the products will only be realized upon delivery and receipt of said products by the purchaser. 

ARTICLE 10: PROTECTION OF YOUR PERSONAL DATA
Paint By Numbers® is the producer and owner of all or part of the databases composing the present site. By accessing this site, the customer acknowledges that the data composing it are legally protected, and notably refrains from extracting, reusing, storing, reproducing, representing or preserving, directly or indirectly, on any type of support, by any means and in any form whatsoever, all or a qualitatively or quantitatively substantial part of the content of the databases appearing on the site he/she is accessing. 

ARTICLE 11: LIABILITY
The descriptions of the products present in the databases of https://www.paint-by-numbers.us/ have been entered according to the information communicated by the publishers. Paint By Numbers® is not responsible for the content of the works and will not be liable to the purchaser. Paint By Numbers®'s responsibility cannot be sought in the event of a case of force majeure (strike, flood, fire ...). 
 
The products offered meet the law of Hong Kong in force. Paint By Numbers® declines any responsibility if the delivered article does not respect the legislation of the country of delivery (censorship, ban of a title or an author...). Paint By Numbers® is not responsible for the contents of the sites on which hypertext links can return starting from its own site. 

ARTICLE 12: APPLICABLE LAW
All clauses contained in these terms and conditions of sale, as well as all purchase and sale transactions referred to herein, shall be governed by the law of Hong Kong. 

ARTICLE 13: ACCEPTANCE OF THE PURCHASER
These general conditions of sale as well as the price lists are expressly agreed and accepted by the purchaser, who declares and acknowledges that he/she has a perfect knowledge of them, and renounces, as a result, to prevail himself/herself of any contradictory document and, in particular, his/her own general conditions of purchase, the act of purchase entailing acceptance of these general conditions of sale.
